मान लीजिए आपके criminal या किसी दूसरे legal proceeding में surety की जरूरत पड़ती है और आपका अपना Advocate कहता है—

“मैं खुद surety बन जाता हूँ।”

सुनने में तो यह बहुत बड़ी मदद लग सकती है।

लेकिन Bar Council of India Rule 10 कहता है कि an Advocate shall not stand as a surety, या अपने client के लिए required surety की soundness certify नहीं कर सकता, जब surety legal proceedings के लिए required हो।

अब सवाल है—

आखिर ऐसी restriction क्यों रखी गई?

क्योंकि Advocate सिर्फ client का personal friend या financial supporter नहीं होता।

वह एक professional और officer of the Court की भूमिका में होता है।

इसलिए अगर किसी case में Advocate खुद surety बन जाए, तो उसकी professional role और personal financial/legal responsibility एक-दूसरे से जुड़ सकती हैं।

और client के लिए सबसे dangerous बात यह हो सकती है कि उसे लगे—

“मेरे Advocate ने खुद मेरे लिए guarantee दे दी है, मतलब सब ठीक है।”

ऐसा conclusion निकालना सही नहीं है।

You are fighting a matrimonial dispute in Delhi.

In Yaduvendra Dalal v. Union of India & Anr., decided on 19 March 2026, the petitioner was the husband in a matrimonial dispute. A criminal case had been registered against him under Sections 34/377/506/406/498A IPC. Because he was not appearing, non-bailable warrants had also been issued.

The Passport Authority subsequently issued a Show Cause Notice and impounded his passport in connection with the pending criminal proceedings.

The husband approached the Delhi High Court.

He explained that the underlying dispute was essentially matrimonial and that an earlier interim order had already permitted him to travel abroad on several occasions.

The Court noted an important fact: despite the pending criminal proceedings, the petitioner was already appearing before the concerned court and there was no apparent violation of the directions permitting his travel.

The High Court ultimately set aside the passport-impounding order and confirmed the earlier interim directions. It also held that the petitioner could apply for renewal of his passport, which was due to expire in August 2026, with the application to be considered according to law.

passport renewal, international travel, employment commitments, immigration paperwork or appearing before the Indian court.

A property dispute can therefore have both civil and criminal dimensions.

- money was paid but the promised transaction failed;

- or a property was dealt with without the owner's valid authority.

Neither assumption is safe.
