THE POINT OF THE JUDGMENT
In Neelam Sharma v. State & Anr., the Delhi High Court examined a complaint concerning alleged cheating and forgery in a property transaction.
The Court considered whether the allegations disclosed cognizable offences requiring investigation, rather than simply treating the dispute as a private civil disagreement.
The important principle is:
The existence of a civil dispute does not, by itself, prevent criminal proceedings where the allegations also disclose cognizable criminal offences.
The precise facts and evidence still matter.
A property dispute can therefore have both civil and criminal dimensions.
WHY THIS MATTERS TO A PROPERTY OWNER
Consider a Delhi businessman who discovers that:
- a sale document is allegedly forged;
- money was paid but the promised transaction failed;
- someone allegedly used misleading documents;
- or a property was dealt with without the owner's valid authority.
The first mistake can be assuming:
“Because property is involved, the police will automatically call it civil.”
The second mistake can be assuming:
“Because I have a property dispute, an FIR must automatically be registered.”
Neither assumption is safe.
The actual complaint, documents and allegations have to be examined against the applicable law.
