A Delhi High Court judgment shows how such a situation can arise.
In Yaduvendra Dalal v. Union of India & Anr., decided on 19 March 2026, the petitioner was the husband in a matrimonial dispute. A criminal case had been registered against him under Sections 34/377/506/406/498A IPC. Because he was not appearing, non-bailable warrants had also been issued.
The Passport Authority subsequently issued a Show Cause Notice and impounded his passport in connection with the pending criminal proceedings.
The husband approached the Delhi High Court.
He explained that the underlying dispute was essentially matrimonial and that an earlier interim order had already permitted him to travel abroad on several occasions.
The Court noted an important fact: despite the pending criminal proceedings, the petitioner was already appearing before the concerned court and there was no apparent violation of the directions permitting his travel.
The High Court ultimately set aside the passport-impounding order and confirmed the earlier interim directions. It also held that the petitioner could apply for renewal of his passport, which was due to expire in August 2026, with the application to be considered according to law.
For a husband facing CAW Cell Delhi, Crime (Women) Cell, 498A/406 proceedings or another matrimonial criminal case, this raises a very practical question:
“क्या matrimonial criminal case चलने का मतलब यह है कि मैं विदेश नहीं जा सकता या passport renew नहीं करा सकता?”
The answer cannot simply be assumed either way.
Passport issues can involve the Passport Authority, pending criminal proceedings, warrants, court permissions and the exact orders passed in the individual case.
And this is why ignoring court dates can create consequences beyond the FIR itself.
A man working in Dubai, Canada, USA, UK or another country may suddenly face a problem with:
passport renewal, international travel, employment commitments, immigration paperwork or appearing before the Indian court.
So if a Delhi matrimonial FIR is already pending, don't treat the passport as an unrelated document.
Keep copies of:
- Passport and previous validity details
- FIR and chargesheet, if any
- Summons/warrants and subsequent court orders
- Bail/interim orders
- Orders permitting foreign travel
- Previous travel permissions and compliance records
- Communications from the Passport Authority
और सबसे important — court की permission को casually ignore मत कीजिए.
A passport problem can become much more stressful when the person discovers it only after a travel date, job requirement or passport-renewal deadline is already approaching.
